Terms and Conditions


Promoter

1. This competition ("Competition") is conducted by TAL Direct Pty Limited (“TAL”, “Insuranceline” or “Promoter”) ABN 60 076 105 130, AFSL 243260 of Level 16, 363 George Street, Sydney NSW 2000, Insuranceline is a trading name of TAL. 

Eligibility

2. All entry instructions and prize information published by the Promoter form part of these conditions. By entering, entrants accept these conditions.

3. The Competition is only open to individuals who: 
i. are Australian residents aged 18 years or older at time of entry who are eligible to apply for and be covered under a new Insuranceline Life Insurance, Income Protection, Funeral Insuranceline policy for themselves and/or another Eligible adult;
ii. at the time of the draw have an active policy and made their first month’s premiums payment; and
iii. who meet all other conditions for eligibility to participate in the Competition as set out in these terms and conditions (for example, and without limitation, the Competition is not available to existing customers of TAL, as well as certain others who are not eligible as set out in these terms and conditions).

4. By entering the Competition, entrants agree to be bound by these terms and conditions. In case of any inconsistency between these terms and conditions and any other published material, these terms and conditions prevail.

Entry

5. The Competition Period commences at 12:00am AEDT on 1 April 2024 and closes at 11.59pm AEST on 31 August 2024 ("Competition Period"). Competition entry commences at 12:00am AEDT on 1 April 2024 and closes at 11.59pm AEST on 31 July 2024 ("Entry Period”). 

6. To enter the Competition, an Eligible Entrant must, during the Entry Period:
i. complete a quote via https://www.insuranceline.com.au/ or over the phone with an Insuranceline representative; and
ii. purchase a new Insuranceline Life Insurance, Income Protection Insurance, or Funeral Insurance policy.
iii. provide a valid email address and phone number at the time purchasing their new Insuranceline policy.

        (“Eligible Entry”)

7. A maximum of one (1) entry into the Competition will be permitted in respect of each Insuranceline branded policy type (e.g. Life Insurance, Income Protection and Funeral insurance are treated as different policy types for the purposes of this Competition) and only where the Eligible Entry requirements in paragraph 6 are met; with each entry per policy type available only to the primary Policy Owner of the policy (and where there is more than one Policy Owner on a policy, only one Competition Entry is permitted per policy and TAL will determine in its discretion the primary Policyholder who is eligible to enter the Competition also provided the Eligible Entry requirements are met).  A maximum of three entries per person will be permitted during the Entry Period.  For example, if an Eligible Entrant buys three policies two of which are the same policy type during the Entry Period and the Eligible Entrant is the single Policy Owner on all those policies, the Eligible Entrant is only eligible for two entries into the Competition, not three.  In all cases no person is eligible for more than three entries. 

8. The Competition is not open to existing customers, or to former customers who have cancelled a policy in the last 12 months immediately prior to the commencement of the Entry Period and who have taken out a new Insuranceline branded policy during the Competition Period. 

9. Entries must be received by the Promoter during the Entry Period.  Entries will be deemed received at the time that the Promoter is satisfied that all necessary requirements under condition 6 have been met, and not at the time of submission by the Eligible Entrant.  

10. It is the entrant’s responsibility to notify the Promoter should their contact details change during the Competition Period.

11. There is no fee to enter this competition. 

Prizes Draws and Winner Announcements

12. During the Competition Period, Eligible Entrants, who the Promoter is satisfied meet all necessary requirements under conditions 5 to 10, will be entered into the relevant monthly draw for the chance to win a prize which corresponds with each Monthly Draw number below. 

13. Eligible Entrants can enter the Monthly Draw/s within the Monthly Entry Period open and close times as below. Entrants will only be included in the Monthly Draw that corresponds with the Monthly Entry Period in which the Promoter receives their entry. Monthly Entry Period for the relevant Monthly Draw (in column (1)) means the period starting on the Monthly Entry Period Entry Start date (in column (2)) and ending on the Monthly Entry Period Entry End date (in column (3)).

14. The four (4) monthly computerised random prize draws will take place at Mike Da Silva & Associates (“MDSA”), Level 16, 1 Denison Street, North Sydney NSW 2060.

15. There will be a total of 5 winners per prize draw, who will each win a $1,000 Digital Visa Card, which will be delivered by email. The maximum retail value of all Prizes in each draw is AUD$5,000.

16. Winners will be notified or attempted to be notified by telephone and email within 2 business days of the applicable draw date, and the Winner’s name and state to be published at https://www.insuranceline.com.au/campaigns/competition-terms from the date of the relevant Monthly Draw for at least 30 days.  It is important that Eligible Entrants provide their correct telephone and email and update the Promoter if it changes before the draw occurs. The Promoter accepts no responsibility for a winner who does not read or access or respond to or answer the email or telephone calls notifying the winner they were the successful winner and such person may forfeit the prize if they do not respond or do not access the prize and activate the card (see Condition 18).

17. Over the four month Competition period there are a total of 20 winners.  Total prize pool value is AUD$20,000. Prizes are subject to these terms and conditions.

18. The $1,000 Digital Visa gift card is issued by Flexewallet Pty Ltd ABN 16 164 657 032 (“Issuer”) at the request of iGoDirect Group Pty Ltd ACN 110 897 320 (“iGoDirect”). iGoDirect has all rights in relation to the True Rewards eGift Card Platform and the Widgets (“True Rewards”). Flexewallet is an authorised deposit-taking institution and a member of Visa. Flexewallet is a member of the Novatti Group and holds an Australian Financial Services Licence, AFSL number 448066. This card must be activated within 6 months of the issue date and will expire 36 months after activation. Unclaimed Prize Draw

19. If any prizes remain unclaimed after two attempts to contact the winner (such attempt may be email or by phone/SMS), this will be published 30 days after the initial prize draw included in condition 13.  Any subsequent unclaimed prize draw will be conducted at MDSA, Level 16, 1 Denison Street, North Sydney NSW 2060. The new winner/s, if any, will be notified or attempted to be notified by telephone and email within 2 business days of the unclaimed prize draw and will have their name published from the dates included below for at least 30 days;

20. The Promoter accepts no responsibility for prizes lost, misplaced or otherwise not delivered to a winner or not claimed by the winner or who does not activate the card (see Condition 18) within six months and the Promoter will not provide a replacement prize or cash for any prize not activated in accordance with Condition 18). If any prize or part of a prize becomes unavailable for reasons outside of the Promoter’s control, the Promoter may substitute a prize of equal or greater value, and “outside the Promoter’s control” does not refer to situations where the prize winner does not activate the card within six months, in which case no replacement prize or cash will be provided to the prize winner). Prizes are not transferable or redeemable for cash. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial and tax advice should be sought.

21. The Promoter’s decision on any aspect of this Competition is final and binding. No correspondence will be entered into.

Fulfilment Details

22. Prizes cannot be transferred, exchanged or redeemed for cash.

23. In the event that a winner does not accept delivery of their Prize in accordance with any conditions of delivery notified to them at the time of redemption, then the Prize will be forfeited and cash will not be awarded in lieu.

24. Insuranceline takes no responsibility for the Prize being lost, stolen, unread or undelivered due to an issue with the recipient’s email mailbox.

General Terms

25. Insuranceline reserves the right to request recipients of the prize to provide proof of identity, and/or proof of offer eligibility in order to claim the Prize. Proof of identification, residency and eligibility considered suitable for verification is at the discretion of Insuranceline and will have regard to any legal requirements applicable. In the event that suitable proof cannot be provided, the Prize will be forfeited in whole, and no substitute offer will be made.

26. Insuranceline reserves the right to disqualify (and not provide the prize to) anyone who tampers with the Competition eligibility process, who games or attempts to game or structure Policy applications or entries into the Competition with the intention of claiming multiple Prizes not within the terms or intent of this Competition, who submits an entry that is not in accordance with these terms and conditions or who has, in Insuranceline’s opinion, engaged in conduct in participating in the Competition which is fraudulent, misleading, deceptive or manipulative, or which is generally damaging to the goodwill or reputation of Insuranceline.

27. If, for any reason, this Competition is not capable of running as planned, including due to computer technical failures; fraud; delays in fulfilling material obligations where such delay is due to industrial action, fire, flood, war, public disaster, delay in transportation; or other causes beyond the control of Insuranceline, which affects the administration, security, fairness, integrity or proper conduct of this competition, then Insuranceline will look to provide a reasonable alternative Competition (but has no obligation to do so and has no obligation to continue the Competition beyond the periods set out in Condition 13).

28. Insuranceline reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition to the extent permissible by law, and subject to any written directions from a regulatory authority.

29. Insuranceline may cancel the Competition at any time, subject to any written directions from a regulatory authority.

Limitation of liability and variation of terms 

30. If any act, omission, event, or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations. 

31. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this Competition, the promotion of this competition or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promoter. 

32. The exclusion of liability in clause 31 above does not apply to limit or exclude liability: 
i. For personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business; or
ii. To the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).  

Entry details and privacy 

33. Entry details remain the property of the Promoter. The names and state of a prize winner may be used for promotional purposes by the Promoter unless the winner otherwise notifies the Promoter at the time of accepting the prize. Entrants consent to the Promoter using personal information provided in connection with this Competition for the purposes of providing insurance cover, facilitating the conduct of the Competition and awarding any prizes. Without limiting the foregoing, entrants' personal information provided in connection with this competition will be handled in accordance with the Promoter's Privacy Statement, visit www.insuranceline.com.au/privacy-policy to obtain a copy.
